What Are the Fastest Ways to Get a Green Card in the US?

Marriage to a US citizen

It is the fastest way to get a Green Card in the US but only if the marriage is in good faith, meaning it is for love and not just to get immigration benefits. The US citizen will be required to petition your application and agree to financially support your stay so you do not become a public charge. It is also available for same-sex marriages. 

Asylum

Back in the mid-90s, asylum applications had an approval rate of 15%, currently, it is around 50% or higher depending on the special circumstances of the case. The applicant must demonstrate that they face the threat of persecution due to their race, religion, nationality, political views or affiliation to a social group. It is also for individuals who have fled their home country out of fear of severe mistreatment. 

Diversity Visa Lottery

Annually, around 50,000 applicants benefit from the Diversity Visa Lottery system. This visa lottery is to encourage immigration from countries that have low levels of immigration. This requires applicants to meet very basic eligibility requirements regarding their age, education level and work experience. However, since the number of applications filed every year is very high, there is a relatively low chance of your application succeeding.

Which Visa Categories Have Been Affected by Longer Wait Times?

There are special immigrant visa categories used by the US immigration system to assign ‘immigrant visa numbers. These numbers assign your application a spot in the line to get a Green Card. There are 2 categories:

Family-Sponsored Preferences: 

These are for family-sponsored preference visas which include:

  • F-1: For unmarried sons and daughters of US citizens: 23,400 visas issued plus any applicant not required for fourth preference

  • F-2: For spouses, children, and unmarried sons and daughters of Permanent Residents: 114,200 visas issued plus any number of applicants by that allows the family preference level to exceed 226,000 plus any unused first preference applicants

  • F-3: Married sons and daughters of US citizens: 23,400 plus any applicants not required by first and second preference

  • F-4: Brothers and sisters of adult US citizens: 65,000 plus any applicant not required by the first preference

Employment Sponsored Preferences: 

The following categories are included in the employment sponsored preferences:

  • EB-1 Visa - Work Visa for Immigrants with Extraordinary Ability: 28.6% of the total employment-based preference plus any applicant not required by the fourth and fifth preferences

  • EB-2 Visa - Work Visa for Individuals with an Advanced Degree or Exceptional Ability: 28.6% of total employment-based preferences plus any applicant not required by the first preference

  • EB-3 Visa - Skilled, Professional, and Unskilled Worker Green Card: 28.6% of total employment-based preference plus any applicant not required by the first and second preference that does not exceed 10,000 

  • EB-4 Visa - Green Card for Special Immigrants: 7.1% of the total level

  • EB-5 Visa - Employment Creation: 7.1% of the total level that is not less than 3,000 for applicants for investment in regional centers and 3,000 for applicants for direct investment in the business of their choice
